Commercial and Litigation

Tim qualified as a solicitor in 2012 having previously studied at the University of Sheffield and Nottingham Law School. He joined Ellis-Fermor & Negus in 2010.

Tim provides advice and representation in relation to a range of civil disputes but with a particular emphasis on:-

  • Inheritance disputes/contested estates;
  • Disputes over jointly owned property;
  • Opposed business tenancy renewals under the Landlord and Tenant Act 1954; and
  • Commercial disputes.

Examples of work undertaken include:

Contentious probate/Estate disputes

  • Securing fix-figure settlement sums for claimants under the Inheritance (Provision for Family and Dependants) Act 1975;
  • Acting for an Executor/Beneficiary in defending a 1975 Act claim against an estate valued at over £400,000, and settling that claim for less than 3% of the estate’s value;
  • Multiple successful applications to the High Court to remove troublesome executors; and
  • Securing a total pay-out of approximately £150,000 for three “disappointed beneficiaries” deprived of legacies from an estate after the solicitors instructed to prepare the deceased’s Will failed to do so before his death.

Trusts of Land/Jointly owned property

  • Succeeding at trial and on appeal before HHJ Godsmark QC in an application to force the sale of property owned by a separated couple;
  • Settling via mediation a complicated and high value claim relating to the division of a number of valuable pieces of land owned jointly by estranged siblings; and
  • Acted successfully for many actual and potential litigants in relation to claims under the Trusts of Land and Appointment of Trustees Act 1996, typically (though not always) following the breakdown of relationships between unmarried partners.

Commercial disputes

  • Successfully resisting a six-figure claim intimated against a Nottingham-based business by a Premier League football club;
  • Successfully resisting a misrepresentation claim threatened by a notorious musical instrument dealer in relation to a guitar signed by an iconic artist;
  • Successfully defending in its entirety a high-value civil fraud/professional negligence claim brought against a firm of accountants following a two-day trial in the County Court; and
  • Acting in a dispute between two Marketing and PR companies concerning alleged conspiracy and misuse of confidential information

Employment disputes

  •  Acting for an employer, settling a disability discrimination claim in the Employment Tribunal valued by the employee at £1.3m for just £22,500;
  • Acting for hundreds of clients in the negotiation and formalising of Settlement Agreements with small local employers to international corporations such as Amazon, Dell and BP; and
  • Acting for employers and employees in relation to disputes concerning, amongst many other things, alleged breaches of restrictive covenants and other breaches of contract.

Tim lives in Chilwell with his wife, Claire, and their two young sons. He enjoys a range of sports, primarily golf and football. He is also an experienced musician.
