FAQs: Divorce Advice

Divorce is the legal process that formally ends a marriage. Beyond filing the application, there are several practical matters to address:

  • Resolving disputes over finances and assets
  • Determining spousal maintenance or pensions
  • Addressing property and housing issues

Seeking early legal guidance helps ensure your rights are protected and reduces the risk of delays or disputes throughout the process.

Step 1 – Considering Divorce

  • Reflect on whether reconciliation is possible
  • Understand the grounds for divorce and eligibility
  • Consider the implications for children, property and finances
  • Obtain preliminary legal advice to plan next steps

Step 2 – Filing the Divorce Application

  • The formal process begins by filing a Divorce Application with the court
  • Your lawyer will draft the application accurately
  • The court will send the applications to your spouse (the respondent)

Step 3 – Response from the Other Party

  • The respondent may agree to the Divorce, defend the Divorce or may not respond
  • If the Divorce is defended, court proceedings wills be necessary
  • Your lawyer will guide you through your options at each stage

Step 4 – Applying for the Conditional Order

If the Divorce is not defended and is acknowledged by your spouse, the next stage is to apply for your Conditional Order. You cannot do this until 20 weeks have elapsed from the date that the application was issued by the court.

Step 5 – Finalising the Divorce

6 weeks and one day after the Conditional Order has been granted you can apply for the Final Divorce Order. This will formally end your marriage.

We normally advise you not to apply for the Final Divorce Order until the matrimonial finances have been resolved and you have obtained an Order from the court to confirm the financial settlement

The welfare of children is the court’s primary consideration in all decisions about arrangements following separation.

We advise on:

  • Where children will live and how time will be shared between parents
  • Decisions about schooling, relocation, and holiday arrangements
  • Resolving disputes through negotiation, or through court proceedings where agreement cannot be reached

Where possible, we aim to help parents reach practical arrangements without unnecessary conflict or disruption, with a focus on what is workable for the children in day-to-day life.

Divorce proceedings begin with a formal application to the court. This can now be done online or by paper form. The application confirms that the marriage has irretrievably broken down. You can apply on your own (a sole application) or together with your spouse (a joint application). We guide you through every step — from preparing the application and reviewing key details such as marriage certificates, to ensuring it is filed correctly and served properly. Early advice helps avoid delays .

A straightforward divorce usually takes around 9 to 12  months from start to finish, although this can vary depending on court processing times and how quickly each stage is completed. There is a built-in 20-week reflection period between the start of proceedings and the application for the Conditional Order. Financial matters or child arrangements can extend the overall timeline if they are complex or disputed. We help keep your case on track and minimise unnecessary delays.

Yes. Many separating couples are able to reach a financial agreement through negotiation, mediation, or solicitor-led discussions without attending a contested court hearing. However, it is essential that any agreement is recorded in a legally binding Consent Order and approved by the court. Without this, financial claims can remain open even after divorce. We help negotiate fair settlements and ensure they are properly formalised for long-term security.

No. Each spouse must have independent legal representation to avoid a conflict of interest and to ensure both parties receive impartial advice. However, we often work in a constructive and cooperative way with the other party’s solicitor to reach practical agreements and reduce conflict wherever possible.

When children are involved, their welfare is always the court’s top priority. We help parents agree practical arrangements covering where children will live, how much time they will spend with each parent, schooling, holidays, and important decisions about their upbringing. Most families reach agreement without court proceedings, but if necessary, we can help apply for a Child Arrangements Order to provide clarity and stability.

Defended divorces are now rare under the no-fault divorce system, but disagreements can still arise about the process or related issues. If your spouse disputes the application, the court will consider the reasons and decide how the case should proceed. We will advise you on the options available and represent you throughout to ensure the process continues smoothly.

Protecting your finances starts with obtaining full and accurate financial disclosure from both parties. We advise on identifying all assets, including property, pensions, savings, and business interests. Interim arrangements may be needed for mortgage payments or living costs while matters are ongoing. Reaching a fair settlement and recording it in a Consent Order is the best way to achieve long-term certainty and prevent future claims.

Yes. Decisions about moving home — especially if it involves relocating a significant distance or abroad — can have a major impact on children and usually require agreement from both parents or court approval.
