Workplace Discrimination

Workplace discrimination and harassment claims

Discrimination and harassment at work can have a serious and lasting impact on individuals and organisations. Employees are entitled to work in an environment that is safe, fair, and free from unlawful treatment, while employers have a legal duty to prevent discrimination and address complaints appropriately and promptly.

Discrimination can arise in many forms, including treatment based on protected characteristics such as age, sex, race, disability, religion, sexual orientation, pregnancy, or gender reassignment. Harassment may involve unwanted behaviour, comments, or conduct that creates an intimidating, hostile, or degrading working environment.

These issues can occur at any stage of employment, including recruitment, promotion, day-to-day workplace interactions, disciplinary processes, or dismissal. In some cases, problems arise from a single incident, while in others they develop over time through repeated behaviour or a failure to address complaints.

Employees who experience discrimination or harassment may be able to bring a claim to an employment tribunal. Employers, meanwhile, may face legal risk if they have not taken reasonable steps to prevent or address unlawful conduct, including having appropriate policies, training, and complaint procedures in place.

At Ellis-Fermor & Negus, we advise both employees and employers on discrimination and harassment issues. We help employees understand their rights, assess whether they may have a claim, and guide them through the process of raising concerns or pursuing legal action where appropriate.

We also support employers in managing complaints, responding to claims, and putting in place practical measures to reduce risk and ensure compliance with employment law.

Our aim is to resolve disputes in a fair and constructive way wherever possible, while protecting our clients’ legal position and helping to maintain respectful and compliant workplaces.

Reviews, what our clients are saying…

‘Ben Bourne is exceptional, and I highly recommend him and Ellis-Fermor. After 30+years of service, I was being made redundant and a had few days to complete a settlement agreement. After cold calling Ellis-Fermor, Ben immediately put me at ease, stepping me through the process and explaining things simply and clearly. Ben took on board my situation and worked diligently to secure an improved redundancy offer within the stringent timescales. I hope not to go through redundancy again, but if I do, I will be calling Ellis-Fermor and asking for Ben.’

‘Charlotte Price at Ellis Fermor & Negus recently advised me on an employment related matter. By responding quickly and giving particularly thorough advice, we achieved a swift and agreeable resolution and with much less stress than would otherwise have been the case. Thank you, Charlotte.’

‘Due to accepting voluntary redundancy I involved this company to read through and advise me on my termination contract. Tim Jones was the solicitor assigned and hand on heart he was brilliant, guiding me through and negotiating where necessary. I would highly recommend this firm.’

‘Ben Bourne dealt with my husband’s redundancy paperwork very professionally today. He checked everything, went through and explained each clause step by step. A friend, who contacted a different solicitor also because of redundancy, said he only went in to sign his paperwork and was only in the office for seconds; at no point was anything explained to him. Ben showed empathy with my husband and seemed genuinely interested in what his next steps were because he asked questions. A true professional. Thanks for making a worrying time much easier, Ben. I will definitely recommend Ben to friends and colleagues.’

‘They demonstrated a strong level of expertise and professionalism throughout my case, ensuring that I fully understood each stage of the process. Their communication was clear, timely, and consistent, which gave me confidence and peace of mind during what could have been a stressful situation. They took the time to listen carefully to my concerns and provided practical, well-considered advice tailored to my circumstances. I felt that my best interests were their priority, and they approached my case with diligence and attention to detail. In addition, their responsiveness and willingness to answer questions made the experience far more manageable. Overall, their combination of legal knowledge, client care, and reliability makes them a firm I would not hesitate to recommend to others.’

Frequently Asked Questions

Discrimination occurs when someone is treated unfairly because of a protected characteristic under the Equality Act 2010. These include:

  • Age
  • Disability
  • Gender, pregnancy, or maternity
  • Race, ethnicity, or nationality
  • Religion or belief
  • Sexual orientation or gender reassignment
  • Marital or civil partnership status

Harassment is unwanted conduct linked to a protected characteristic that:

  • Violates an individual’s dignity
  • Creates an intimidating, hostile, degrading, or offensive environment

Discrimination and harassment can be direct or indirect, and may occur between colleagues, managers, or third parties interacting with the workplace.

Employees facing unfair treatment, harassment, or discrimination often feel isolated or unsure how to proceed. We support employees to:

  • Assess whether the treatment constitutes unlawful discrimination or harassment
  • Navigate internal grievance procedures effectively
  • Gather evidence and document incidents
  • Consider mediation or alternative dispute resolution
  • Bring Employment Tribunal claims where necessary
  • Seek compensation, remedies, or corrective actions

Our step-by-step guidance ensures employees understand their rights, avoid procedural mistakes, and pursue claims confidently.

Employers must act proactively to prevent discrimination and harassment, respond to complaints fairly, and manage legal and reputational risk. We assist employers to:

  • Develop policies, procedures, and training programs that comply with employment law
  • Respond to internal complaints promptly and fairly
  • Investigate allegations thoroughly and impartially
  • Defend claims in tribunal or settlement contexts
  • Minimise potential financial and reputational exposure

By providing clear guidance, we help employers maintain staff morale, ensure compliance, and create workplaces that are inclusive and safe

Discrimination and harassment disputes can often be resolved without formal tribunal proceedings. Common resolution methods include:

  • Internal grievance procedures – structured processes to address complaints
  • Mediation or alternative dispute resolution (ADR) – facilitated discussions to reach agreement
  • Employment Tribunal proceedings – when internal resolution is not possible

Our approach is practical and proportionate, focusing on solutions that minimise disruption, protect reputations, and ensure compliance with legal obligations.

Practical Tips for Employees

  • Keep a record of incidents, including dates, times, and witnesses.
  • Follow the company grievance procedure, but seek advice before submitting formal complaints.
  • Consider mediation or informal resolution where appropriate.
  • Understand the scope of your legal rights under the Equality Act 2010.

Practical Tips for Employers

  • Ensure policies clearly define discrimination and harassment and the procedure for reporting concerns.
  • Provide training for managers and staff on legal compliance and handling complaints.
  • Investigate complaints impartially and promptly, documenting every step.
  • Maintain confidentiality and fairness to protect all parties involved.

Yes. Properly conducted grievance procedures often resolve disputes before they escalate to tribunal claims, while demonstrating compliance with employment law.

Most claims must be submitted to an Employment Tribunal within 3 months minus one day from the date of the discriminatory act or last incident. Early advice is critical.

Yes. We advise both sides to achieve fair, compliant, and legally robust outcomes.

Yes. Many cases are resolved through negotiation, mediation, or settlement agreements, which are often faster and less costly than formal proceedings.

Evidence may include emails, witness statements, records of meetings, HR documentation, and notes of incidents. We advise clients on how to gather and present evidence effectively.

Failure to follow internal policies or statutory requirements can increase the risk of tribunal awards, compensation, and reputational damage. Early legal guidance can prevent this.

If you are an employee experiencing discrimination or harassment, or an employer seeking to prevent or respond to claims, our team provides practical, expert, and legally robust guidance.
