There is no requirement under UK law to use a solicitor to make a valid WIll. Making a Will does technically not require the help of a solicitor. But there are certain circumstances where getting legal advice is indispensable such as:
- where your estate and the way you want to pass it on are not straight forward.
- where you have remarried and have children from a previous marriage
- where you have property or investments based outside the UK
- where there is a business involved
- where you are supporting someone with disabilities
- where you are concerned about the possible impact of care fees
- where Inheritance Tax could potentially be an issue for your estate
It is a valid truism that you get what you pay for! You may find it cheaper to use a Will writer but can they provide a holistic understanding of the law which is essential when advising on legal matters. Will writers cannot store your Will for you as most solicitor can either.
The disadvantages of writing your own Will:Buying a Will kit yourself may seem like the cheapest and most simple option but do you really know that much about probate law? Probably not!
Asking an experienced probate lawyer to write your Will for you will ensure it is legally valid.
Do it yourself or badly made Wills can by just as bad (and sometimes worse!) than making no Will at all.
