Are decisons made in mediation legally binding?

  • No, proposals made in mediation do not constitute binding agreements. If you have applied for a divorce or civil dissolution order then it is usual for the Judge to make an order based on your agreement. This is called a Consent Order and is binding. One of your solicitors will draft the order and the other will receive a copy.
  • Alternatively, if you are not going through divorce or civil dissolution, one of your solicitors will draft a binding separation agreement or Deed of agreement.
